The high court was informed by the Election Commission (ECI) that BJP chief JP Nadda, who received a notice on April 15, was anticipated to respond to the notice by May 15.

The Delhi High Court on Monday dismissed a petition seeking action against Prime Minister Narendra Modi for allegedly delivering communally divisive speeches that violated the model code of conduct during the Lok Sabha election campaign. The court stated that it could not interfere with the Election Commission of India (ECI) proceedings, which were still ongoing. Justice Sachin Datta emphasized that the ECI had not concluded its investigation and urged patience as the commission addressed the matter.
Several individuals, including Abdullah, filed numerous complaints against PM Modi for violating the code of conduct, but the Election Commission of India (ECI) allegedly took no effective action in response.

ECI’s Handling of Hate Speech Complaints: Petitioners’ Critique and ECI’s Response
The petitioners criticized ECI for failing to issue a notice to PM Modi but only to the BJP president regarding the alleged hate speech, which they argued hindered the conduct of free and fair elections. They pointed out that while ECI took action against leaders from other parties for hate speeches, it had imposed a 48-hour gag order on former Telangana chief minister and BRS chief K Chandrashekhar Rao earlier in the month.
During the hearing, lawyer Suruchi Suri, representing ECI, stated that the poll panel had issued a notice to the BJP president on April 25 and expected a response from the ruling party by May 15. She emphasized that ECI would take appropriate action in accordance with the law upon receiving the reply and referred to the ECI advisory sent to all parties, cautioning them about strict consequences for direct and indirect violations of the poll code.
