US Supreme Court rejects Tahawwur Rana’s extradition plea

On Thursday, the US Supreme Court dismissed the plea of 26/11 terror attack accused Tahawwur Rana against his extradition to India, following US President Donald Trump’s recent approval of the process during his meeting with Prime Minister Narendra Modi.

Rana, 64, who has ties to Lashkar-e-Taiba (LeT) terrorist David Headley, is currently held in a Los Angeles prison.

He had submitted an “Emergency Application for Stay” to the Associate Justice of the US Supreme Court and the Circuit Justice for the Ninth Circuit.

Legal Battle Ends as US Supreme Court Refuses Stay

A note dated March 6, 2025, on the US Supreme Court website states, “Application…denied by Justice Kagan.” Tahawwur Rana submitted the application to Associate Justice of the US Supreme Court, Elena Kagan, as a last-ditch effort to prevent his extradition to India.

The rejection of Rana’s plea follows the approval of his extradition by President Donald Trump’s administration. Earlier, Trump announced that his government had sanctioned the extradition of the “very evil” terror accused, whom Indian investigative agencies want for his role in the 26/11 Mumbai attacks. He stated that this decision would ensure the accused “faces justice in India.”

In his petition, however, Rana contended that his extradition would violate US law. He also argued that it would breach the United Nations Convention Against Torture. He asserted that “substantial grounds” indicated he would face a serious risk of torture if sent to India.

His application further emphasized that this risk was particularly severe because he is a Muslim of Pakistani origin accused in the Mumbai attacks. It claimed that the likelihood of torture in his case was significantly higher due to these factors. This assertion reinforced his argument against extradition.
