Tehelka Founder Tarun Tejpal Convicted in 2013 Workplace Rape Case

The Bombay High Court convicted Tehelka founder Tarun Tejpal in the 2013 rape case on Thursday. The Goa bench overturned the 2021 trial court judgment that had acquitted him of all charges. The court held him guilty under multiple provisions of the Indian Penal Code related to rape and sexual harassment. The judges announced that they would pronounce the quantum of punishment later in the day. The case originated from allegations made by a former Tehelka employee during the magazine’s ThinkFest event in Goa. According to the complaint, the assault occurred inside a hotel elevator in November 2013. The High Court concluded that the earlier acquittal could not stand after examining the evidence and legal arguments. The ruling marks a significant development in one of India’s most closely watched criminal cases involving a prominent journalist.

High Court Overturns 2021 Acquittal, Finds Tarun Tejpal Guilty

The High Court convicted Tejpal under Sections 376(2)(f), 376(2)(k), 354A, and 354B of the Indian Penal Code. These provisions address rape, sexual harassment, and assault involving criminal force against women. The judges stated that the evidence justified reversing the previous acquittal issued by the Goa sessions court. The court’s decision followed detailed hearings and consideration of the prosecution’s appeal against the earlier verdict. The Goa government had challenged the acquittal soon after the trial court delivered its judgment in 2021. The High Court accepted the appeal and delivered a conviction after reviewing the complete record. The verdict reinforces the importance of judicial scrutiny in serious criminal cases involving allegations of sexual violence. The sentencing hearing remained pending after the conviction order.

Tarun Tejpal appeared before the High Court during the pronouncement of the judgment. He requested leniency, citing his age, family circumstances, and previous time spent in jail. His legal counsel urged the court to suspend the conviction order for eight weeks. The defence argued that Tejpal intended to challenge the judgment before the Supreme Court through an appeal. The prosecution strongly opposed the request for leniency and emphasized the seriousness of the offence. Solicitor General Tushar Mehta argued that the accused occupied a position of trust toward the complainant. He urged the court to send a clear message that consent must always be respected. The prosecution maintained that the law should protect survivors and uphold accountability.

Defence Seeks Leniency as Court Prepares to Announce Sentence

The case began after a former Tehelka employee accused Tejpal of sexually assaulting her during the ThinkFest event in Goa. The alleged incident occurred inside the elevator of a hotel where the event took place. The trial started in 2017 before a Goa sessions court and continued for several years. In 2021, the trial court acquitted Tejpal of all charges after evaluating the evidence presented. The Goa government later challenged that verdict before the Bombay High Court through a formal appeal. During the appellate proceedings, both sides presented detailed legal arguments supporting their positions. The High Court ultimately concluded that the acquittal required interference and convicted the former editor. The judgment significantly changed the legal outcome of the long-running case.
