Election Commission Fact-Checks Rahul Gandhi’s Form 6 Allegations

The Election Commission called Rahul Gandhi’s allegations about Form 6 changes misleading during Bihar’s SIR exercise. The poll body responded on X Monday after Gandhi cited an earlier statement concerning Form 6.

Gandhi alleged that Chief Election Commissioner Gyanesh Kumar changed Form 6 unilaterally without proper approval. The Commission rejected that allegation and carefully defended procedures followed during the ongoing revision exercise. It said Commission members approved the order launching SIR in Bihar on June 24, 2025. The Commission also cited a Supreme Court judgment dated May 27, 2026, supporting that order. According to the poll body, the Supreme Court upheld the Commission’s decision to conduct SIR.

SC Examines Changes to Form 6 Amid Gandhi’s Allegations

The Commission referred specifically to its September 26 press note addressing the disputed declaration. Point 1(iii) of that note said the Supreme Court upheld Form 6’s attached declaration. However, the Commission did not answer Gandhi’s central question about the modified Form 6 version. Gandhi’s specific allegation concerned whether Kumar introduced the revised form without receiving proper Commission approval. The dispute became central during Monday’s Supreme Court hearing concerning the controversial Form 6 declaration. A bench led by Chief Justice Surya Kant said judges would examine the official records.

Justices Joymalya Bagchi and V Mohana also joined the Chief Justice during Monday’s hearing. The bench said records would establish who introduced specific changes to the Form 6 declaration. The Chief Justice clarified that the court had not approved any modified Form 6 version. He said judges wanted records to identify who introduced those changes after the disputed modification. The court made those formal observations while hearing advocate Shailendra Mani Tripathi’s petition seeking prosecution. Tripathi accused the Chief Election Commissioner and other officials of making unilateral decisions concerning SIR. Form 6 allows citizens to apply for inclusion in electoral rolls for the first time.
