The ED has receive Home Ministry approval to prosecute AAP chief Arvind Kejriwal and ex-Delhi Deputy CM Manish Sisodia in the money laundering case tied to the scrappe Delhi excise policy.

The Ministry’s decision comes after Delhi Lt Governor VK Saxena approve the prosecution of the former Delhi Chief Minister in the case.
This development allows the investigation agency to file charges against the former Delhi CM and his deputy, intensifying their challenges ahead of the February 5 Delhi Assembly election.

The trials may commence once charges are file against Kejriwal ministry, potentially complicating his return as Delhi CM.
In a November ruling, the Supreme Court mandate that the Enforcement Directorate must secure prior approval before prosecuting public officials.
The following month, the investigation agency wrote to the Lt Governor, asserting that sanction should be approve as Kejriwal is the “mastermind and main conspirator” in the scam.
In response to the Enforcement Directorate’s (ED) move to prosecute him and others in the money laundering case linke to the Delhi excise policy, Aam Aadmi Party (AAP) chief Arvind Kejriwal approached the Delhi High Court. Kejriwal argue that the chargesheet file by the ED is illegal and should be dismisse. As it was submitte without obtaining prior sanction from the competent authorities, which is a requirement for prosecuting public officials. According to Kejriwal’s legal team, the chargesheet was filed in violation of the Supreme Court’s directive that mandates the ED to seek approval from the relevant authorities before initiating any prosecution against public servants
