The Maharashtra government has suspended four Food and Drug Administration (FDA) officials over alleged procedural violations. The action includes two assistant commissioners and two food safety officers. Authorities have also ordered departmental inquiries against all four officials. The suspension orders came from the Medical Education and Drugs Department on Friday. The officials had handled enforcement proceedings against manufacturers and traders of flavoured and scented hookah tobacco products. The authorities identified the suspended officers as D V Bhogawade, Y B Dahatonde, C R Swami and A Y Ilager. Bhogawade served as Assistant Commissioner (Food) in Pune, while Dahatonde held the same position in Nagpur. Swami and Ilager worked as food safety officers across Pune, Nagpur and Solapur. The government initiated action after reviewing cases involving M/s SOEX India Pvt Ltd and M/s High Street Impex LLP. Both companies faced proceedings over flavoured hookah tobacco products.

Maharashtra Government Flags Serious Procedural Lapses
The suspension orders highlighted several shortcomings in the officials’ handling of the cases. Authorities alleged that the officers failed to establish whether the products qualified as food under the Food Safety and Standards Act, 2006. They also questioned whether the Food Safety and Standards Authority of India (FSSAI) had jurisdiction over these products. The officials allegedly failed to examine product classifications, labels and intended uses properly. The products carried declarations stating that manufacturers intended them for hookah smoking, not consumption. Investigators also flagged inadequate checks of export-related details and supplier information. The officers reportedly did not verify manufacturer records before initiating enforcement action. These shortcomings raised concerns about the legal basis of the proceedings. The government stressed that officials must establish jurisdiction and examine relevant facts before taking regulatory action against businesses.
The government also identified gaps in inspection records, sample documentation and stock verification. The officials allegedly failed to distinguish properly between finished products and raw materials. They also did not adequately assess whether the products belonged to food or non-food categories. Authorities raised concerns about the use of coercive measures without sufficient legal examination. The orders questioned whether the officials considered proportionality before taking action against the companies. They also highlighted the need to evaluate whether less restrictive measures could achieve the same regulatory purpose. In the SOEX India case, the order against Bhogawade specifically cited a failure to exercise due diligence. It stated that he did not adequately examine the relevant legal and factual aspects before initiating action. The government also questioned the justification behind the measures taken against the company.

Departmental Inquiries Ordered Against All Four Officials
The Maharashtra government has ordered departmental inquiries against all four suspended officials. Authorities will conduct these proceedings under the Maharashtra Civil Services (Discipline and Appeal) Rules, 1979. The inquiries will examine the alleged procedural violations and the officers’ responsibilities in the cases. The suspension orders also stressed the importance of proper verification before enforcement action. Officials must seek legal opinions whenever necessary and confirm FSSAI’s jurisdiction. They must also examine product classifications, labels and intended uses before initiating proceedings. The government has warned that authorities may take strict action against officials found responsible for procedural violations. These directions aim to strengthen accountability and ensure that regulatory officers follow established legal procedures. The department will assess the officials’ conduct through the prescribed inquiry process before reaching further conclusions.
The suspension orders also referred to proceedings before the Bombay High Court involving the two companies. These proceedings included issues concerning the release of seized goods and the reopening of sealed factories. The court-related developments formed part of the government’s review of the enforcement actions. The department highlighted the need for officials to follow proper legal procedures while handling similar cases. It also emphasised that regulatory authorities must verify facts and jurisdiction before taking action. The suspension of the four FDA officials marks an important administrative response to the alleged lapses. However, the departmental inquiries will determine the extent of individual responsibility. The case has also brought attention to the need for clear regulatory oversight of flavoured and scented hookah tobacco products. Officials must now establish whether the alleged violations occurred and whether the enforcement actions followed the applicable legal framework.
