Bombay High Court Grants Interim Bail to Naresh Goyal in Money Laundering Case

On Monday, the Bombay High Court granted Naresh Goyal, the founder of Jet Airways, temporary release for two months on medical grounds. The Enforcement Directorate (ED) had apprehended Goyal in connection with a money laundering investigation. Under the ruling of Justice N J Jamadar, Goyal must furnish a surety of ₹1 lakh and refrain from leaving Mumbai without prior authorization from the trial court.

According to the statement, the bench declared that it would grant interim bail to the applicant (Goyal) for a period of two months, and he must adhere to all imposed conditions. Naresh Goyal, aged 75, had requested interim bail, citing medical and humanitarian reasons, as he and his wife, Anita Goyal, are both battling cancer.

Bombay High Court’s Decision and Goyal’s Legal Proceedings

ED arrested Goyal in September 2023 over allegations of money laundering and diverting loans amounting to ₹538.62 crore from Canara Bank, which were provided to Jet Airways. His wife faced arrest in November 2023 following the ED’s chargesheet submission. She was granted bail by the special court on the same day, considering her age and health condition. While a special court denied bail to Naresh Goyal in February, it permitted him to receive medical treatment at a private hospital. Subsequently, Goyal approached the Bombay High Court, seeking bail based on case merits and interim bail due to medical reasons.

During the hearing, Goyal’s counsel Harish Salve urged the court to consider the plea on humanitarian grounds, highlighting Goyal’s physical difficulties and mental strain due to his wife’s similar health condition, expressing his wish to be with her during her final days.

The Enforcement Directorate opposed the plea, citing the absence of a recent medical report, and expressed willingness to extend Goyal’s hospitalization. ED’s counsel Hiten Venegaonkar suggested extending Goyal’s hospitalization for four weeks before requesting a fresh medical report to evaluate his condition.
