The Nagpur bench of the Bombay High Court acquitted ex-Delhi University professor G N Saibaba and co-accuse on Tuesday in a case involving suspect Maoist links. The court allow their appeals, overturning convictions.
The decision was deliver by a division bench, consisting of Justices Vinay G Joshi and Valmiki SA Menezes, on Tuesday. The bench concluded the proceedings and deferred its judgment back in September of the previous year, following explicit instructions from the Supreme Court.
The Nagpur bench of the Bombay High Court grants acquittal to G N Saibaba and four others sentenced to life imprisonment in 2017 for suspected Maoist connections. The court ruling directs the release of the accuse, who were arrest in 2013 on charges of being associate with the banned Communist Party of India (Maoist) and the Revolutionary Democratic Front.

Supreme Court Special Sitting Challenges Bombay HC Verdict on Maoist Case
On October 14, 2022, Justices Rohit Deo and Anil Pansare, the former now resigned, overturn convictions and order the release of four individuals in a Maoist-linked case. Emphasizing the necessity of due process and noting the absence of a valid sanction under the Unlawful Activities (Prevention) Act (UAPA), the bench declare the sessions court proceedings as “null and void.”

The subsequent day saw a special Supreme Court sitting, responding to the state government’s plea for a stay on the high court verdict. Justices M R Shah (now retired) and Bela M Trivedi presided over the session.

On the very day of the Nagpur bench’s decision, the Supreme Court intervened, suspending the order. The apex court expressed a prima facie opinion that a thorough examination is necessary concerning the high court’s judgment. Emphasizing the importance of addressing various legal questions, the Supreme Court took a cautious approach, temporarily halting the implementation of the Bombay High Court’s decision.
Supreme Court Overrules Bombay HC Decision in Saibaba Case, Orders Fresh Hearing
In April 2023, the Supreme Court nullified the Bombay High Court’s order clearing Saibaba and co-accused, instructing a fresh examination by a different bench. The apex court mandated a conclusive resolution within four months. The subsequent proceedings before the new bench culminate on Thursday as the case awaits judgment.
