Delhi Chief Minister Arvind Kejriwal Granted Bail by SC in Excise Policy Case

Delhi Chief Minister Arvind Kejriwal has been granted bail by the Supreme Court in the excise policy case. A Bench comprising Justices Surya Kant and Ujjal Bhuyan presided over the matter. Reserving the case for judgment on September 5. According to the cause list on the Supreme Court’s website, both justices are set to deliver separate verdicts. While they agreed on granting bail, they differed on the legality of Mr. Kejriwal’s arrest.

The Central Bureau of Investigation (CBI) had argued that Kejriwal should first approach the trial court for bail. However, the Supreme Court referred to its recent ruling in favor of former Delhi Deputy Chief Minister Manish Sisodia. Where it emphasized that a person should not have to face unnecessary obstacles in seeking bail, especially in matters concerning personal liberty. Mr. Sisodia had also been granted bail in a related liquor policy case.

ED and CBI Arrests Keep Kejriwal Behind Bars Despite Interim Bail

Senior Advocate A.M. Singhvi, representing Kejriwal, argued that the Delhi Chief Minister, being a “constitutional functionary,” poses no flight risk and that there is no threat of evidence tampering since the material evidence is documentary and has already been collected.

Kejriwal was arrested by the Enforcement Directorate (ED) on March 21 for alleged involvement in a money laundering case connected to the now-defunct Delhi excise policy. Later, the CBI arrested him on June 26 in a related corruption case. Although the Supreme Court granted him interim bail in the money laundering case on July 12, he remained in custody due to the CBI’s case. Among the 40 accused in the excise policy-related cases, only Kejriwal and businessman Amandeep Singh Dhall remain in jail.
