Financial Dominance Over Wife Cannot Be Termed ‘Cruelty’: Supreme Court

Apex court quashes dowry harassment case, says monetary control without proven harm does not attract criminal liability

The Supreme Court has ruled that a husband’s financial or monetary dominance over his wife does not, by itself, amount to “cruelty” under criminal law unless it causes clear mental or physical harm. The apex court observed that parties should not use criminal proceedings as a tool to settle personal vendettas arising from marital discord.

A Bench headed by Justice B.V. Nagarathna made these observations while quashing a dowry harassment case filed by a woman against her husband and his family members. The court held that complainants must support allegations of cruelty and harassment with a series of specific and serious acts and clearly spell out the role of each accused to justify the initiation of criminal proceedings.

Bench warns against misuse of criminal law, calls routine financial disputes part of married life

The court examined the woman’s claims, including her allegation that she had to maintain detailed household expense accounts while her husband transferred large sums of money to his parents and siblings for business purposes. The Bench noted that, without evidence of tangible mental or physical suffering, such claims reflected the “ordinary wear and tear of married life” rather than criminal cruelty.

Emphasising caution, the Supreme Court said vague or general accusations cannot justify invoking criminal provisions related to cruelty and dowry harassment. The court reiterated that authorities must use criminal law sparingly and only in cases involving demonstrable abuse, warning that indiscriminate prosecutions weaken the credibility of genuine complaints.
